Privacy Policy This Privacy Policy outlines how Playmi.ca, a music streaming platform and mobile app owned and operated by Playmi Inc., collects, uses, and manages your personal information. By using the streaming platform (defined below) and/or by registering for a user account, you consent to our Privacy Policy. It's important you read it to your discretion and become familiar with this privacy policy. If you do not agree to any of the terms, policies, or conditions in this Privacy Policy, you should not use the Playmi Inc. music streaming platform's website, mobile website, mobile apps services or platform in general. Please note: This Privacy Policy only applies to the Playmi.ca website, mobile website, mobile app, and any additional music delivery mechanism or platform developed thereafter and/or utilized in any way, shape or form by Playmi Inc. (collectively hereby referred to as the "Platform"). When experiencing the Platform you may engage with links and/or ads for other brands, services, platforms, apps, and/or websites that are not a part of the Services Playmi Inc. offers. Playmi Inc. assumes no responsibility for the privacy policies or activities of such third parties, and users should be sure to check the privacy policy of any third-party site or platform they use or engage with.

1 - Introduction/Overview

The Playmi Inc. Privacy Policy will provide users with a detailed explanation of how Playmi Inc. collects and uses a user's information on the Platform. A user's experience is important to Playmi Inc. and so Playmi Inc. would like to provide users with a brief overview of our mandate as it pertains to the user privacy policy and to highlight some key basic concepts.

By using the Platform, you consent to the collection of certain types of information (outlined below). You should fully understand what Playmi Inc. will do (and won't do) with your personal information.

Playmi Inc. would also like to provide an overview of what you will be consenting to as a "user" by using the Platform. All of these points will be explained in more detail below.

By using the Platform, you consent to;

The potential sharing of your information to a 3rd party outside of the country you reside in;

The collection, processing, use, and sharing of your information;

The public availability of certain kinds of personal information you elect to share by registering for an account, and your controls for sharing such information.

2 - Information Playmi Inc. collects about you

Visiting and using the Platforms home page does not require users to provide any personal information, however, having full access to the Playmi Inc. website, mobile website, and mobile application requires users to register for a user account. Users will provide certain information as they complete the registration process:

Opt-In/Registration Data:
To register for a Playmi Inc. account, users must provide a valid email address as well as their age. If users use Social Login (e.g. Gmail, Instagram, Twitter, Facebook, or Spotify) to sign up, Playmi Inc. may receive some of this information from the social network. Users may elect to provide Playmi Inc. with other personal information - personal/artist biography, hometown, and links to their user profiles on other social media platforms (Facebook, Instagram, Twitter, etc).
Playmi Inc. also collects and displays the date of your initial user registration on your user profile as a month and year - e.g. January 21. Users will also provide certain personal information if users use Playmi Inc. Contact Us tools, on-site forms, or send Playmi Inc. an email regarding support, a user account, or other topics.
Users may also provide other personal information through their use of the site and posting of audio material, in the track description, comments, or title fields.

Data Playmi Inc. collects on usage, analytics, and cookies:
By using the Platform, you consent to Playmi Inc. using various technologies and methods that collect information about how users use, access, and interact with the Platform, which may include any of the following;

Technical data such as a user's IP Address, geolocation, cookie data, URLs visited, mobile device ID and information, device attributes, operating system, network connection, browser type, language, and mobile app version.

Details of any searches users make using the Playmi Inc. search tools, including the date and time searches were made.

Analytics and metrics regarding the duration, time, and frequency of a user's visits to and interactions with the Platform. Details of a user's subscription (if applicable), as well as information about the user's interactions with the Platform, specifically including but not limited to: streams, playlists, likes, favourites, use, and interaction with other Playmi Inc. members and/or artists.

Device sensor data including lat/long, geolocation, altitude, and measurements from a user's mobile device's gyroscope, GPS receivers, accelerometers, and other sensors.

Details of a user's interaction with any third-party apps, widgets, modals, and/or advertisements that are linked to or made available on the Platform.

Information about the website users visited immediately prior to a user's interaction with the Platform. Details of any content (music, song information, descriptions) users upload to the Platform.

Details concerning user's interaction with any Platform methods of communication specifically including but not limited to emails and push/in-app notifications, such as whether users opened and/or clicked on such messages.

Playmi Inc. may also obtain information about users from any 3rd party providers/partners and/or advertisers on the Platform which measures ad interaction.

3 - How Playmi Inc uses your information

Playmi Inc. may use users information for any of the following purposes;

To operate your Playmi Inc. account, and to identify you when you use the Platform. Your email address and password are used for this identification;

To identify you and your actions (uploads, streams, likes, favourites, playlists, comments, etc) on the Platform; To provide technical functionality to the Platform; for research and development of new products, services, or functionality; and analyze your use of the Platform;

To provide you with technical support or assistance;

To communicate with you for marketing, support, and/or promotional purposes through email, push, or in-app notifications, and or text message;

To detect fraud or attempted manipulation of Playmi Inc. charts, trending sections, or proprietary algorithms. Playmi Inc. expressly reserves the right to remove any and all content from the Platform that Playmi Inc. in its sole discretion reasonably believes that may be violating any copyright laws and/or is being used in any way, shape or form to manipulate any measurement system on the Platform (specifically including but not limited to any charts, trending, top chats, proprietary algorithms, streams, favourites, etc;

To provide users with advertising, added features, updated information, relevant links, customized messaging, or other curated content based on a users geolocation and time of use;

To determine the location, orientation, and acceleration of a mobile device;

To ensure compliance with the Terms of Service (TOS), this Privacy Policy, or with any applicable local, provincial, federal, or international Copyright Laws;

Information about a users subscription tier (Gold, Platinum) if applicable; Does not apply

To serve users relevant ads on behalf of advertisers and/or sponsors, which may include location and sensor data, along with demographic data users make available to Playmi Inc. or through connected third party services, recent search history, and behaviour with content, ads, or other users on the Platform; To provide users with a customized and curated experience on the Platform. To provide the content creators and rights holders that provide audio content to the Playmi Inc. platform with statistics on who is listening to their content.

4 - How Playmi Inc. shares users information

Information about a user or a user's activity on the Platform may be shared in two ways: the first is information a user shares through their public profile on the Platform is publicly visible to other users of the Platform and thus is shared. The second is data and information Playmi Inc. collects on a user (as described in section two above) that Playmi Inc. may in its sole discretion share with reputable third parties to help enhance the Platform, its analytics and services to provide users with amazing experiences.

Information users share through the use of the Platform:

Any information a user provides in their public profile (username, name, location, social media feeds) and/or use of the Platform (upload, streams, favourites, playlists) is public and may be seen by other users on the Platform or by Playmi Inc. administrators.

Information Playmi Inc. shares:

Playmi Inc. uses several reputable third-party partners and services, based in Canada., to enhance the security, functionality, reliability, utility, and profitability of the Platform and to provide certain specialized services for Playmi Inc. stakeholders. Playmi Inc may also store a user's email address, device id, and other tokens in services that enable Playmi Inc to send targeted messages to users via email, push notification, and on-platform messaging. Although Playmi Inc. is not responsible for the Privacy Policy or Data Security of said third-party services, Playmi Inc. emphasizes data security and integrity as a top priority when selecting services to work with.

Playmi Inc. will disclose a user's personal information in any case where it is necessary to do so to comply with a criminal complaint, subpoena, court order, or legitimate law enforcement inquiry.

Playmi Inc. may disclose a user's personal information if it feels it is necessary to do so to protect Playmi Inc.'s intellectual property, rights, business interests, or the safety or reliability of our platform, users, employees, or stakeholders.

Playmi Inc. may transfer a user's information to any person or party that acquires all or a substantial portion of Playmi Inc.'s company or assets, or in the case of a merger, acquisition, or if the company becomes insolvent. Notwithstanding any other provision, Playmi Inc. might partner with third parties that collect information across various channels, both offline and online, for purposes of delivering more relevant advertising experiences to users or a user's business. Playmi Inc. partners may place or recognize a cookie on your computer, device, or directly in Playmi Inc. emails and communications, and may share personal information with them if users have submitted such information to Playmi Inc. such as hashed email addresses, social accounts. Playmi Inc. partners may connect personal information Playmi Inc. shares with them to the cookie stored on a user's browser or device, and may collect relevant information such as the IP address, operating system and demographic information. Playmi Inc. partners use this information to recognize users across multiple channels and various platforms, including but not limited to, computers, mobile devices, and Smart TVs, overtime for marketing and advertising, analytics and metrics, attribution, and reporting purposes. For example, Playmi Inc. partners may deliver an ad to users in a user's web browser based on a purchase a user made with an online vendor or may send a personalized marketing email to a user based on the behaviour of the user on a third party website. A user's data may be transferred outside of the country from which it was originally collected. 5 - How Playmi Inc. uses cookies and technology

Playmi Inc. uses cookies and related technologies to enhance the Platform experience and to provide years with a more consistent experience, record sign-ins, and registration details to serve users more relevant marketing and advertising communications. Some ads served by third parties may use limited information about a user and a user's interaction with the Platform to enhance the targeting or retargeting of advertisements and marketing communications. Users may refuse to accept cookies from Playmi Inc. and/or the Platform by declining the Desktop Notification policy that appeared to a user the first time a user views the Playmi Inc. Desktop Platform(s).

In case a user was wondering, a cookie is a small file placed on a users computer or mobile device when the user visits a website which helps the Playmi Inc. site and its 3rd party advertising and data partners to recognize a users device the next time that same user visits the site. Cookies are essential for many simple functions such as recognizing an occasional user when they log in and providing the user access to their user account, favourites, playlists, and their personal user profile. Playmi Inc. utilizes two common types of cookies - session-based cookies (which expire once a user closes their web browser) and persistent cookies (which stay active until deleted or deactivated after a set period of time). Other technologies include pixel tags (transparent images which help Playmi Inc. determine if a page or email has been viewed by a user), web beacons (also known as web bugs, which serve a similar function to pixel tags), and web storage. Additionally, mobile users may be tracked using Device ID and/or hashed data to identify repeat or occasional mobile/tablet usage. These combined technologies are used both by Playmi Inc. and its 3rd party partners to ensure essential Platform functionality; target, serve, measure, and monitor advertising delivery, targeting, ads optimization, and of course performance; measure Platform analytics and usage; and to measure user and audience behaviour, trends, demographics, and location.

Playmi Inc. does not currently respond to or acknowledge Do Not Track (DNT) requests.

6 - Accessing and updating your information

Users may update their personal information at any time by visiting their "my account" Dashboard page in their user profile. Please bear in mind that profile data that is updated may take a few hours to update internally.

A user's data will be deleted if the user deletes their account, which can be done by accessing "my account" on the Playmi Inc. desktop site and clicking the "Delete account" button. This can take some time so please be patient as profile data may still appear on internet search engines for some time after deletion due to caching.

Please note, logging out of or deleting the mobile app from your device does not delete a user account.

Users accessing Playmi Inc. from an android or iOS mobile devices may also opt-out of any sales of their personal information by using their mobile platform settings (on iOS, by enabling the "Limit Ad Tracking" setting, and on Android devices, by enabling the "Opt-out of Ads Personalization" setting).

FOR European and California Users: In the event, a user would like to withdraw their consent for Playmi Inc. to collect their information, users have the right to obtain from Playmi Inc. the erasure of a users personal data concerning the user themselves without undue delay and Playmi Inc. shall have the obligation to erase this user's personal data without undue delay. In the event users elect to withdraw their consent for Playmi Inc. to collect data, a user can contact Playmi Inc. by sending an email info@playmi.ca from the email address associated with a user account OR by logging into a user account and submitting a support ticket requesting that Playmi Inc. erase any and all personal data concerning the user. Once received, Playmi Inc. shall process a user's request in the order it was received and shall erase their data without undue delay. A user may use these same methods to request that Playmi Inc. send any and all the data that has been stored that is related to a specific user's account.

7 - Transfer to other countries/territories

Playmi Inc. is based in Canada and follows all applicable Canadian laws concerning data storage and privacy. Although Playmi Inc.'s third-party providers and services could be based all over the world, there may in some circumstances be cases where data is transmitted to servers outside of Canada. as part of the business as usual operation of the Platform. Users must be aware that not all countries have the same data storage and privacy laws as Canada, and by using the Playmi Inc. Platform you consent to the storage, transfer, collection, and transmission of your data to other countries and territories also.

8 - Links

The Platform might contain links to third-party content, marketing and advertisements, and sites that are not owned by nor affiliated with Playmi Inc. Playmi Inc. cannot be held accountable for the content or privacy policy of third-party sites. As an internet or data plan user, please be sure to read any or all privacy policies to determine if you as a user are comfortable with how certain third parties will handle your information.

9 - Children

This Platform is not intended for use by those under the age of 13. Playmi Inc. never knowingly or purposefully collects information from anyone under the age of 13, or under the legal age limit in their respective province, territory, or country ("Age Limit"), under any circumstances. If you are a user under the Age Limit, you should not use the Platform and are expressly prohibited from registering for a user account or transmitting any data or personal information on the Platform. If you are the parent/guardian of a child under the Age Limit and believe Playmi Inc. may have collected such information, please contact us immediately at info@playmi.ca and it will be removed swiftly.

10 - Changes to the Playmi Inc. Privacy Policy

Playmi Inc. may, at its sole discretion, change the terms of this Privacy Policy at any time and for any reason. In the event that Playmi Inc. does change this Privacy Policy, Playmi Inc. will post notification of updates both within the Privacy Policy itself and through timely notifications throughout the Platform and specifically on the Playmi Inc. website and mobile app. Please be sure to read all updates to the Privacy Policy thoroughly before continuing to use the Playmi Inc. platform. Your continued use of the Platform constitutes acceptance of any new or changed terms in this Privacy Policy.
